Family Life in Constitutional Perspectives: A Constitutional and Islamic Analysis

Abstract

Families are widely recognized as the foundation of societies, states, and civilizations. This article examines family life from a constitutional perspective, focusing on legal protections relating to marriage, family autonomy, privacy, parental authority, children’s welfare, equality, and protection from discrimination. It explores how constitutional principles respond to the changing nature of family life in modern society. The study draws upon Pakistan’s constitutional framework, international human rights instruments, comparative case law from the United States, Europe, the Middle East, and South Asia, and relevant Islamic teachings in the Qur’an. It recognizes the family not only as a social institution but also as a moral responsibility founded on justice, compassion, and mutual respect. The article argues that constitutional protection should extend beyond formal recognition of the family to ensure substantive justice by addressing domestic violence, child neglect, forced marriage, economic exploitation, and abuse, thereby safeguarding the dignity, security, and well-being of all family members.
